Fabricata Cut is provided as a South African software-as-a-service platform for steel cut-to-size operations, stock control, cut optimisation, cutting lists, material and offcut tracking, labels, and report exports.
Acceptance of Terms
By creating an account, using the Sample Optimiser or trial access, subscribing to a plan, uploading data, or using any output from Fabricata Cut, you agree to these terms and the related policies linked from the legal centre. If you use the service for a company, you confirm that you are authorised to accept these terms for that company.
About Fabricata Cut
Fabricata Cut helps users organise steel cutting work, review available stock and offcuts, prepare cutting layouts, and export documents for operational review. It is a planning and workflow tool, not a replacement for engineering, production, procurement, workshop supervision, or quality control.
Eligibility and Account Registration
You must provide accurate account, company, billing, and contact information. You are responsible for keeping login credentials confidential and for all activity under your account or workspace.
Trial and Sample Optimiser Access
Trial or Sample Optimiser access may use sample data, restricted features, limited usage, or temporary access. Sample outputs are for evaluation only and must not be treated as production-ready cutting instructions.
User Responsibilities
Users must use Fabricata Cut lawfully, enter accurate information, review all outputs, and maintain suitable internal controls before issuing cutting lists, ordering material, reserving stock, or manufacturing components.
Accuracy of User Input
Fabricata Cut relies on user-entered information. You are responsible for checking drawings, dimensions, quantities, material grades, heat numbers, certificate numbers, stock lengths, kerf, tolerances, offcut records, and project assumptions before using outputs.
Generated Outputs, Reports and Optimisation Results
Cutting lists, optimisation layouts, BOQ-style reports, labels, stock allocations, offcut suggestions, PDF exports, CSV exports, and traceability reports are operational aids. You remain responsible for verifying that every output is complete, accurate, current, and appropriate for production use.
Subscription Plans, Billing and Access
Subscription plans, pricing, usage limits, billing cycles, payment methods, activation status, and access rules are displayed in the product or on the pricing page. Access may be limited until payment is completed or verified under the applicable billing model.
Upgrades, Downgrades and Usage Allowances
Plans may include user limits, cut allowances, stock-row limits, or other operational limits. Projects are not capped by plan. If an allowance is reached, the service may require a plan change, administrative action, or a new billing period before additional usage is available.
Suspension and Termination
Fabricata Cut may suspend or terminate access where an account is unpaid, expired, misused, compromised, used unlawfully, or reasonably believed to create operational, security, legal, or billing risk.
Prohibited Use
You may not use Fabricata Cut to break the law, bypass billing or usage controls, attack the service, upload harmful files, reverse engineer the platform, scrape content at scale, or interfere with other users.
Third-Party Services
Fabricata Cut may use third-party providers for hosting, databases, storage, email, analytics, support, payment processing, or related operations. Those services may have their own terms and privacy notices.
Intellectual Property Reference
Fabricata Cut software, code, user interface, workflows, report templates, branding, documentation, and product design are protected intellectual property. See the Intellectual Property and Data Ownership Policy for more detail.
Customer Data Ownership Reference
Customers retain ownership of their own uploaded project data, drawings, stock data, material records, certificates, and business information. Fabricata Cut receives only the rights needed to provide, secure, support, and improve the service.
Privacy Reference
Personal information is handled according to the Privacy Policy / POPIA Privacy Notice. Users should not upload unnecessary personal information into project fields, file names, reports, or material records.
Disclaimers
Fabricata Cut does not certify engineering, fabrication, procurement, production, or compliance decisions. Outputs may be incomplete or incorrect if input data is incomplete, outdated, wrongly interpreted, or inconsistent with real-world workshop conditions.
Limitation of Liability
To the maximum extent allowed by South African law, Fabricata Cut will not be liable for indirect, special, consequential, operational, production, material, rework, downtime, lost profit, lost revenue, or third-party losses arising from use of the service or reliance on outputs.
Indemnity
You agree to indemnify Fabricata Cut against claims, losses, costs, or damages arising from your unlawful use of the service, inaccurate data entered by you, unauthorised user activity, misuse of outputs, or breach of these terms.
Changes to the Service
Fabricata Cut may update, improve, remove, suspend, or change features, workflows, reports, pricing, limits, and integrations as the service develops. Reasonable efforts will be made to avoid unnecessary disruption to active customers.
Changes to These Terms
These terms may be updated from time to time. The updated version will be posted on the website or in the application with a new last-updated date. Continued use after publication means the updated terms apply.
Governing Law
These terms are governed by the laws of the Republic of South Africa. South African courts will have jurisdiction unless another lawful dispute process is agreed in writing.
